These Terms of Service govern use of the girlinmindx.shop website and purchases made through the store.

By accessing the website or placing an order, users agree to these Terms to the extent permitted by applicable law.

Nothing in these Terms limits mandatory consumer rights that cannot legally be waived or restricted.

We aim to display product information accurately.

Product photographs are intended to illustrate the relevant products. Colors and appearance may vary slightly due to device settings, photography, lighting, manufacturing tolerances, or product updates.

Nothing in this section limits a customer's statutory rights where goods are defective or fail to conform to the contract.

4. Prices

The price applicable to an order is the price displayed during the purchasing process, subject to correction of obvious errors where legally permitted.

Any taxes and other mandatory price components will be handled and displayed in accordance with applicable requirements.

Customers will have an opportunity to review the total price before submitting a binding order.

5. Orders and Contract Formation

Products displayed on the website may constitute an invitation to customers to submit an order rather than a binding acceptance by girlinmindx.shop.

A customer submits an order by completing the checkout process and using the final order button.

The precise point at which a binding contract is formed depends on the checkout process and applicable law, but the customer will receive appropriate electronic order information or confirmation.

We may reject an order where legally permissible, including where a product is unavailable, payment cannot be authorized, order information is materially inaccurate, fraud is reasonably suspected, or fulfillment would be unlawful.

6. Payment

Customers must pay using a payment method offered at checkout.

Payment services may be provided by Shopify, Shopify Payments, card networks, banks, digital-wallet providers, or other third-party payment service providers.

Customers are responsible for providing accurate payment information and for having authority to use the selected payment method.

7. Shipping

All orders receive free standard shipping.

The estimated delivery time is 15–20 days, unless a different timeframe is expressly stated for a particular order.

Where no specific delivery period has been agreed, mandatory German consumer-delivery rules remain applicable. German Civil Code provisions state that where no delivery period has otherwise been determined, a trader must generally deliver no later than 30 days after conclusion of the contract.

8. Delivery Information

Customers must provide a complete and accurate delivery address.

Where delivery is delayed or fails because information supplied by the customer is materially incorrect or incomplete, we may contact the customer to arrange an appropriate solution.

The statutory allocation of risk during consumer delivery is unaffected by these Terms.

9. Right of Withdrawal

Consumers purchasing online in Germany and the European Union generally have a statutory right to withdraw from qualifying distance contracts within 14 days of receiving the goods, subject to statutory exceptions.

If a product is defective or non-conforming, customers may be entitled to remedies available under German consumer-sales law.

These rights exist independently from the 14-day statutory withdrawal right and are not reduced by any voluntary return policy.

11. Returns and Refunds

Returns and refunds are governed by our Return and Refund Policy and applicable mandatory consumer law.

A valid refund will normally be returned through the original payment method unless otherwise agreed without additional cost to the customer.

12. Website Use

Users may use the website only for lawful purposes.

Users must not intentionally:

interfere with website security; introduce malicious software; attempt unauthorized access; misuse checkout systems; impersonate another person; use stolen payment information; conduct fraudulent transactions; scrape or reproduce protected website content unlawfully; or use the website in a manner that violates applicable law.

13. Intellectual Property

Unless otherwise stated, website content made available by girlinmindx.shop, including original text, graphics, design elements, layout, and other protectable materials, may be protected by applicable intellectual-property law.

No ownership rights are transferred merely because a user accesses the website.

Third-party trademarks and materials remain the property of their respective owners.

14. Third-Party Services

The store may rely on Shopify and other external services for ecommerce infrastructure, payments, shipping, analytics, communications, or other functionality.

Where a third party independently provides a service directly to the customer, its terms may also apply to that service.

15. Availability

We aim to maintain website availability but cannot guarantee uninterrupted or error-free access.

Temporary interruptions may occur because of maintenance, technical problems, security incidents, network failures, Shopify platform issues, or other circumstances outside our reasonable control.

Mandatory consumer rights relating to existing orders remain unaffected.

16. Liability

Nothing in these Terms excludes or restricts liability where exclusion or restriction would be unlawful.

In particular, nothing is intended to exclude mandatory liability for intentional misconduct, gross negligence where liability cannot legally be excluded, injury to life, body, or health, liability under mandatory product-liability rules, or other liability that German law requires to remain available.

Any permissible limitation of liability will apply only to the maximum extent allowed by applicable law.

17. Force Majeure and Events Outside Reasonable Control

Where performance is delayed by an event outside our reasonable control, we will take reasonable steps appropriate to the circumstances.

This section does not remove rights customers have under mandatory law concerning delayed or failed delivery.

18. Privacy

Use of personal information is governed by our Privacy Policy and applicable data protection legislation.

19. Changes to These Terms

We may update these Terms for future use when our business processes, services, legal requirements, or Shopify functionality changes.

Changes will not retroactively deprive customers of contractual or statutory rights already acquired under an existing order.

20. Governing Law

These Terms are governed by applicable German law to the extent legally permissible.

Where a customer is a consumer, nothing in this choice of law removes mandatory consumer protections available under the law that otherwise applies to the consumer.

No provision is intended to impose an unlawful exclusive court jurisdiction on a consumer.

21. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain effective to the extent permitted by law.

The invalid provision will be interpreted or replaced only to the extent allowed by applicable law.
